Terms & Conditions of Sale

These Terms & Conditions apply to all quotations, orders, supply, fabrication, delivery, and installation services provided by Rocca Stone and Porcelain Ltd trading as Rocca (“Rocca”, “we”, “our”, or “us”).

By accepting a quotation and/or paying a deposit, the client (“the Client”) agrees to be bound by these Terms & Conditions as published on our website at www.roccastone.co.uk.

1. Payment Terms

A 50% deposit is required upon acceptance of the quotation to secure materials and schedule templating.

Following template approval, the remaining balance is payable in full prior to fabrication and installation unless otherwise agreed in writing. In certain cases, Rocca reserves the right to require full payment for materials in advance.

All materials remain the property of Rocca Stone and Porcelain Ltd until payment has been received in full.

2. Quotations & Pricing

All quotations are provided for information purposes only and do not constitute a binding offer.

Orders are only accepted once confirmed in writing by Rocca. All prices include VAT unless otherwise stated.

Quotations are based on the information available at the time they are issued. Rocca reserves the right to amend quotations where project specifications, material costs, supplier pricing, site conditions, or customer requirements change prior to final confirmation. Additional work, changes, or variations requested after acceptance of the quotation may incur further charges.

3. Stone Characteristics & Material Disclaimer

Marble, granite, quartzite, quartz, and porcelain are products with inherent natural or manufacturing characteristics. Variations in colour, veining, pattern, texture, shading, and movement are normal and should be expected. Certain natural stones may contain resin filled areas, fissures, pits, crystalline deposits, or markings which are characteristics of the material and do not constitute defects.

Samples are indicative only. Exact matches cannot be guaranteed. Matching veining, patterns, or shading across joints and seams cannot be guaranteed.

Marble and certain natural stones may be more susceptible to etching, staining, or surface marking depending on usage and maintenance.

Rocca shall not be liable for natural fissures, hairline cracks, or movement caused by structural settlement, external pressure, thermal movement, impact, or site conditions beyond our control.

4. Templating, Fabrication & Installation

Templating

All cabinetry, appliances, flooring, walls, and supporting structures must be fully installed, level, secure, and structurally sound prior to templating.

The Client, or an authorised representative, must be present during templating to confirm all project details including cut outs, tap hole positions, edge profiles, overhangs, material orientation, splashbacks and upstands.

The final template and specification must be approved and signed off at the time of templating.

Any alterations requested after templating may incur additional charges and may require a further site visit and re templating. Rocca accepts no responsibility for changes made to cabinetry, walls, appliances, flooring, or site conditions after templating has been completed.

Cabinets, walls, and surfaces may not be perfectly level or square. Minor variations or gaps resulting from site conditions are considered acceptable industry tolerances.

Fabrication

Seams, joint positions, and fabrication methods are determined at Rocca’s discretion to ensure structural integrity, material performance, and overall aesthetics. The placement of seams and joins may vary from visual quote expectations.

Minor manufacturing tolerances, polishing variations, or edge detail differences may occur as part of the fabrication process and shall not constitute defects.

Installation

The Client must ensure safe and suitable access for delivery and installation. Additional charges may apply where restricted access, stairs, lifting equipment, parking restrictions, delays, or additional labour are required.

Our installers do not carry out plumbing, electrical, joinery, tiling, decorating, or remedial building works (unless specifically agreed in writing).

Sinks, taps, hobs, and appliances must not be connected or used until installation has been fully completed, approved and 24 hours has passed since installation.

Silicone, sealant, resin, and colour matched jointing materials may vary slightly in appearance and may require maintenance over time.

Installation dates are estimates only and may be affected by circumstances outside of Rocca’s control including supplier delays, transportation issues, weather, or manufacturing delays.

Once installation has been completed, risk and responsibility for the materials passes to the Client.

Remnants & Offcuts

Any intended use of remnants or offcuts should be discussed and agreed prior to fabrication.

Unless otherwise agreed in writing before fabrication, Rocca will not retain or store remnants or offcuts following completion of the project. Any agreed collections must take place within 7 days of installation unless otherwise agreed.

5. Delivery & Ownership

Estimated delivery and installation dates are subject to material availability and scheduling.

Ownership of all materials remains with Rocca Stone and Porcelain Ltd until full payment has been received. Risk passes to the Client upon delivery or installation, whichever occurs first.

Any visible damage, defects, or concerns must be reported immediately upon delivery or completion of installation.

6. Acceptance

Any concerns relating to fabrication or installation must be reported in writing within 48 hours of installation. No claims can be considered once the product has been altered, modified, or worked on by third parties.

Where the Client, or their authorised representative, is not present during installation, the installation shall be deemed accepted once fitted.

7. Cancellation & Refunds

Orders cancelled prior to templating may be subject to material restocking charges, supplier cancellation fees, and any costs already incurred by Rocca.

Once templating has been completed, the order is considered bespoke and non refundable.

Following fabrication, no cancellations, refunds, or returns are possible unless required under applicable consumer law. Any approved refunds shall exclude costs already incurred by Rocca including, but not limited to: templating, material purchases, fabrication, transport, installation, supplier charges.

8. Limits of Liability

Rocca shall not be liable for delays or failure to perform obligations caused by circumstances outside of our reasonable control.

Rocca shall not be liable for: structural movement, site defects, actions of third parties, misuse of the product, improper maintenance, accidental damage, damage caused by other trades.

Liability is strictly limited to the value of the materials and services supplied by Rocca.

Rocca shall not be liable for any indirect, consequential, or associated costs including plumber, electrician, joiner, decorator, accommodation, or loss of use expenses.

Nothing within these Terms & Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any liability which cannot legally be excluded under Scottish law.

9. Indemnity

The Client agrees to indemnify and hold harmless Rocca Stone and Porcelain Ltd, its employees, contractors, and representatives against any third party claims, losses, damages, liabilities, or expenses arising from: breach of these Terms & Conditions, misuse or improper maintenance of the product, works carried out by third parties following installation, inaccurate information or instructions provided by the Client.

10. Force Majeure

Rocca shall not be liable for delays or failure to perform obligations where caused by circumstances beyond our reasonable control including, but not limited to: Supplier shortages, transport delays, machinery breakdown, accidents, extreme weather, strikes, utility failures, governmental restrictions, acts of God.

11. Care & Maintenance

The Client is responsible for following all care and maintenance guidance supplied by Rocca. Failure to follow recommended care procedures may invalidate any applicable warranty or goodwill consideration.

12. Photography & Marketing

Rocca reserves the right to photograph completed installations for portfolio, website, advertising, and marketing purposes unless otherwise agreed in writing by the Client. No personal information or identifying details will be disclosed without permission.

13. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.
